is it safe to turn on the computer to just test out if everything is working fine, evan with out a case fan? and will turn off after to see if it runs

Yes. - Leave the side cover off however.
But before you do that, it's always a good idea to just go over everything, to make sure everything is plugged/screwed in correctly and you didn't leave anything on the motherboard like a screw or something.

All I did was hold the case occasionally to get rid of any static build up. My brother did the same, so you should be fine without a static wrist band. They're cheap though, so buy one if it's convenient for you to get one.

How much did you get your 7850 for? I've been thinking about upgrading my 7770 to a 7850 or 7870, but I may just go with the 7970 next Summer.

yea thats a good idea to touch the case. I paid $200 for the gpu. 7970 i would imagine being quite a beast, I'd do it to if i had the money lol

Woah, woah, woah, $200 for a 7850??  I've been watching gpu prices a fair bit lately and that sounds like a major ripoff

Just last week actually, the MSI 7850 was going for a measly $110 after rebate (http://slickdeals.net/permadeal/104494/newegg---msi-radeon-hd-7850-2gb-gddr5-pci-express-3.0-video-card-amd-silver-reward-bundle-2-select-games)

Hell, even the XFX 3gb 7950 with limited lifetime warranty was cheaper than $200 (only $180 after rebate, and it came with the gold rewards instead of silver so 3 free games instead of 2.  I believe it also came with a Crysis 3 voucher at the time of the deal, so 4 games in total) last week (http://slickdeals.net/f/6345472-xfx-double-d-fx-795a-tdkc-radeon-hd-7950-black-edition-3gb-179-99-ar-newegg)

I'd return that gpu if I were you

There's been lots of good deals lately on the higher tier 7xxx series cards lately.

after picking up all the final hardware.. keyboard, mouse, wi fi usb, dvd drive. New case fan i was sure it said 135 mm but when i opened up the front it said 120 mm... is it possible to rig somthing up for the 135? or keep to the traditional 120 and return it.

Well. You could just screw the fan in with a single screw, as long as it's moving air and won't fall off you should be fine.
Remember though, fans on the back/top of the case should push air out. Fans on front and on the side of the case should push air in.

Also, you sure it's 135mm and not 140mm? 135 seems like an odd number IMHO.

Congratulation on your first build :D Saved money, got a better spec and above all, downright satisfying when its up and running isn't it? :)

Intel core i7 930 OC @ 4.0 ghz

XFX Double dissipation Radeon HD 7950 356 bit 3gb GDDR5 OC @ 1150 MHz core + 1575 x 4 memory

Triple channel DDR 3 12gb RAM 1600 MHz

I am wanting to buy windows 7. Should I use a OEM, to fully install it from scratch?

Yeah. OEM is fine. Make sure it's Home Premium 64bit and you're set.
You could also go for Windows 8.1 as an alternative too.

case fans should the air be blown inwards into the computer on a front mounted fan? so the opposite side of the sticker facing.

and connect to a molex or to mother board.
