The same way they release updates, they could release the download of the game as an optional update. 

But only those who bought MCC before end of December or something will get it for free, that's why they send all of thsoe who have played the game before end of December a code. An optional update would work for everyone but it's not supposed to be for everyone.

Looks like there was no reaction towards this in this thread but I won't say why.

I think people are overestimating how MS is paying so many more western devs to work on games. Sure, MS didn't pay for a JRPG but they also didn't pay for a WRPG as much as I know (except for a marketing deal). MS paid some more western devs in general but there are more western devs as Japanese devs so that if MS pays let's say 4x as many western devs it's not a surprise if there are 4x as many western devs on the market. Not to forget that it should be much harder for MS to get contracts with Japanese devs if they prefer so much to make games for Nintendo and Sony. They will probably ask for more money to get convinced to make a game for XBO as they ask Sony/Nintendo for.

In my opinion it didn't really look as if MS paid many devs at all this gen. They do get many more wester games but because western devs simply make games for XBO and many Japanese devs simply don't work on XBO games and never considered doing so even the year before release of the console.

The only issue I really see is that MS doesn't have a Japanese studio, they should have one since, as console manufacturer, you should have studios in all big gaming territories to produce own games typical of these regions but that they invest more money in western third-party devs isn't really any surprise.

There simply comes a lot together which doesn't make it so easy for MS and what they do with Japanese devs.

I did a quick google search and X1 indeed does only allow games with gold as long as you have gold. Interesting as I assumed the policy was the same as 360.
