Nintendo is not at gamescom plus i heard there is no call of duty being made for the 3DS just yet. only n-space developes them, and they i'm sure they said they weren't making one. i may be wrong, but that's what i know

I thought I read somewhere a few days ago that n-Space had stopped producing ported shooters for Nintendo handhelds due to consistently poor sales.  That included 3DS as well as DS.

Possibly.

I think it was just a bad port... i.e. cash-in. Maybe built initially from whatever engine they use in Wii cod titles.

But, Activision has yet to mention anything cod + Nintendo related and this cod was never said to be exclusive, I don't think.

So its very possible that it will be on both mobile platforms and possible iOS/Android latest stuff in the near future. Tegra3 stuff looks as good as that or better. I'm positive the iPhone5 and 2013 Androids will match Vita's hardware. So this could just be Activision planning ahead.

I just watched the trailer again just to make sure I wasn't going crazy. The graphics seem fine to me, I find them more impressive than Uncharted: Golden Abyss's.

Aren't there like 4 CoD games on the original DS though? They all use touch screen.

They looked and played terrible though. The PSP version was terrible to play too, I don't see them using the same control scheme for the 3DS version. They could port it but it would have to be drastically changed.
