Two things factor in here:

A: Is the developer owned or partly owned by the publisher?

B: Is the developer making a game that relates to some other thing the publisher has control over? (be it a console, an online play platform, an online service)

If either A and B are true, you can bet that the publisher is going to have a lot more control than they would otherwise. Like with Zangeki no Reginleiv which i'm currently playing, one wonders whether Nintendo forced Sandlot to use Motion Plus, as well they could despite not owning Sandlot. Similarly in this case. I'm not certain of the relationship between Jaffe's group and Sony anymore, but if Jaffe is making a game that uses PSN, Sony is certainly going to have the right to dictate *how* the game uses PSN
