i dont see a problem here. his actions caused the event. its not like he accidentally fell on the tracks some how. he is legally responsible for the injuries regardless of whether or not hes alive, because they are the direct result of his inappropriate actions.

his negligent action caused someone to be injured.  what caused the injuries or whether hes alive or not is totally irrelevant.  she has every right to seek compensation from the deceased estate.
