Judge halts showing of explicit videos during trial

It was about 20 minutes into the first of dozens of explicit masturbation videos that showed a man accused of making child pornography having sex with a children's doll when Ontario Court Justice Robert Fournier declared he had had enough.

"We are not paid by the taxpayers to sit here and torture ourselves," Fournier said after watching the first few clips in one of the disturbing videos seized by police from Richard Osborn's south Ottawa townhouse in December.

The video showed a naked Osborn lying on top of the toy, which had been altered to allow him to penetrate it. The head of the Cabbage Patch-style doll also had its mouth carved out to facilitate other sex acts.

Osborn, who frequently looked back toward the camera, could also be seen putting on women's pantyhose and wearing women's underwear and shoes.

Many of the shots focused on his feet and toenails, which had been painted pink.

"I don't know if I need to see any more of these," Fournier said after watching parts of the video, which was played in open court as an agitated Osborn covered his eyes and sighed loudly in the prisoner's box. "I've had my fill of it right now."

Fournier's comments came after defence lawyer Graham Murray objected to the playing of the video, questioning its relevance.

"To parade my client's sexual practises in front of a court like this is highly prejudicial," Murray said. "You aren't going to see any naked children."

While prosecutor John Ramsay acknowledged Osborn's sexual practices on the videos were "perfectly legal," it was the interspersing of clips of children that Osborn allegedly secretly filmed on a beach and playing in a backyard that elevated it to the production of child pornography.

Clips of a little girl in a pink bathing suit along with the bottom of a 14-year-old girl playing with a hose were repeatedly stopped, rewound, and paused on Osborn's video before it cut back to him masturbating.

A box containing an additional 37 VHS tapes containing a mix of Osborn masturbating, adult pornography and the clips of the children was also seized.

Police also found two pictures of characters from The Simpsons television show engaged in sex acts in the recycle bin on Osborn's computer. One picture showed Milhouse, Lisa and Bart Simpson engaged in "hard-core pornographic activity," according to Ramsay.

More child pornography and photos of bestiality and Osborn exposing himself were found next to the chair where he could frequently be seen masturbating in the video.

Osborn has pleaded not guilty to making and possessing child pornography along with voyeurism and possession of a dangerous weapon, a set of nunchuks.
