Xbox 360 owners, many of whom have pleaded innocence, have reported receiving permanent bans from the online gaming service up to 12/31/9999.

In a thread on the Xbox.com forum titled "Suspended for Marketplace Theft?", a spokesperson for Microsoft explained that the action was in response to those who had "illegitimately" accessed downloadable content.

"During the course of a recent investigation, we have discovered users who illegitimately accessed Xbox Live Marketplace downloadable content," the spokesperson said.

"Our investigation reveals that this access was intentional and not accidental, constituting a blatant violation of the Terms of Use for the service. We will not divulge additional information regarding individual suspensions for these offences.

"Please know that we are being very careful regarding these suspensions, and have clear evidence regarding each account issued a permanent suspension from the service. We apologize for any frustration or confusion resulting from our inability to share individual details, and thank you all for your cooperation in this matter."

Do they tell what the users were doing to get the ban?

My friend said JTagged consoles had the ability to get DLC for free, or outright XBLA games and It's been going on for quite some time now.

Wow I can see why they would ban people with those type of consoles.

No this is not the case at all.

Microsoft gave a few thousand accounts live points on accident. The people getting banned spend those live points in the mean time instead of reporting it.

Credible, yet the source itself is entire speculation. This is not an explanation or proof that what you said is happening, therefore I stand by my original statement that Microsoft is not permanently banning people for using points they received via a glitch MS caused.

Now, if the story is also mistaken on the glitch, and it was actually points given via means of hacked/stolen points codes and other jtagg-enabled glitches, then yes, those people who got free points should be banned for knowingly receiving those points in an illegal way.

If MS caused the glitch, they would NOT be banning people as that article speculates. That's not theft and it would be MS responsibility to remove the content from the person, not ban them. Same as when a bank makes an error and gives someone money that isn't theirs. They don't arrest the person if that someone uses the money. They either take it back (if not already spent) or take they cut themselves.
