In 2004 Peter Hochstein and Jeffrey Tenenbaum sued Microsoft over a 10-year-old patent for "communicating live while playing the same video game in separate locations." After six years of legal tomfoolery, a U.S. District Judge has dismissed the case.

Hochstein and Tenenbaum sued both Sony and Microsoft for patent infringement in 2004, claiming that both companies employed methods similar to the ones described in their patent to allow two players to communicate while playing a video game in two different places. Here's the exact wording, from the patent:

A local video game including a communicating controller. The controller receives local command signals created by a set of player controls. The controller also receives remote command signals received through a modem which were created by a remote video game through a similar set of player controls. The controller includes a synchronizer which produces synchronizing codes to be sent to the remote video game to synchronize the games. The synchronizer synchronizes the local and remote command signals such that both are received by a game microprocessor simultaneously. Memory stores the player parameters and are retrieved whenever the synchronization codas of the local and remote video games have not matched for a predetermined number of iterations.

It seems a bit of a long shot, but the similarities were enough to make Sony settle out of courtfor an undisclosed sum last year.

Perhaps Sony's lawyers should have taken a tip from Microsoft's. The Xbox manufacturer battled it out, and was rewarded by having U.S. District Judge Paul D. Borman dismiss the case on July 20. Borman ruled that the patent covered game systems connected electrically, which did not cover the network connections Xbox Live players use to connect to one another.

in Sony's case it seems like once bitten twice shy, I wonder if they had a clause inserted in there payout like MS did in regards to Sony winning /losing it case over dual shock patents.

 I wouldn't be surprised if Sony's payout was in the ballpark of what MS's legal bill ended up.

sadly, its more than just the end sum for sony and microsoft.   this also helps make sony look like easy pickings to other patent trolls out there and provides these particular trolls with money to fund their other schemes.

Agreed and the same could be argued for Nintendo I do believe they are being sued at the moment ,plus all we hear about are the ones that get to court I wonder how many are settled with a small royalty cheque. what we need is a time limit on certain patent's in regards to bringing the ideas to market  something along the line of when a Sony -MS -NINTY or whoever are forwarding their patents for approval they must have a case for using said patent in a timely fashion or risk losing it and the same for those already holding patents in that they have to reach certain milestones depending on the patent type to keep a full entitlement.

Even sadder is the same six years it takes to settle a fatal car accident claim when the driver drunk at the time runs down two females at a bus stop while they waited to catch a bus  early morning , one being my wife dies and the other her sister spends 3 months in hospital with multiple fractures to her legs, a broken pelvis broken left arm, broken jaw all her front teeth removed two large rods inserted to support her legs eventually removed and he pleaded guilty, the Insurer finally made a settlement six years latter on the front step of the court house the day of the trial, according to my sister in laws Lawyer the amount was pretty much what she would have been awarded if it went to judgment and the Insurer was always going to pay up so why six years ?.
