In theory, yes, it does. But I doubt the courts are going to rule in Sony's favor on a hypothetical argument. At its core, the PS3 hack is no different than Jailbreaking. It's the unlocking of hardware purchased and owned by the consumer for use not intended by the original manufacturer. And yes, some of that use will probably be malicious.

Most, if not all, of the use has been malicious so far. Here's hoping the courts do see that.

people living in gated communities give up their right to decorate their homes anyway they want to because that is the kind of community they want to live it.  don't buy a house in a gated community and then complain your rights are being infringed upon.  it was your option to pick what you want to buy.

geohot isn't the guy hacking games, he's just the guy that took down the gate that let's everyone else in.  without the code that geohot distributed everyone else would have stayed the bleep out.

..and excuse me for being worried.  i personally don't want to wait until everything has gone to shit before getting involved (or at least expressing my opinion as the case may be).

Sony had every right to take Geo to court.  The problem here is not the lawsuit itself, it is the fact that the court ruled in Sony's favor (when really they should have thrown it out to begin with). 

The question i'm asking myself is "what does sony get if they win?", I mean wouldn't have been easier to hire him an put him on the security team?

They will end up with information they should not have: The IP addresses of everyone who watched the videos, the financial records of everyone who donated to Geo...etc. 

You know, there has to be more to this entire endeavor.  Sony has to be looking for something in particular in all of this personal info. 

 

Let me be clear tho.  I believe Sony had every right to seek legal action in every aspect possible.  Does that mean they should win every suit they bring forward? No.

First, knowing an IP address reveal your ISP name and location, not your personal name and address. 

Second, what you mean by "financial records" is:

"“documents sufficient to identify the source of funds in California that went into any PayPal account associated with geohot@gmail.com for the period of January 1, 2009 to February 1, 2011.”"

And last but most important:

"Tuesday's order by US Magistrate Judge Joseph C. Spero said the information subject to Sony's subpoena “shall be provided on an Attorneys' Eyes Only basis” and is limited to information relating to whether Hotz has enough ties to Northern California to be sued in federal court in that district."

In other words, nothing will happen from the informations reveal by the subpoena other then what concern Geohot.
