if you are only protected from unreasonable searches...and its not unreasonable to be expected to be searched when boarding a plane, for everyones safety, then its not unconstitutional.

Leaving aside how that's quite different from what you said earlier, I have to point out that this is not exactly what "unreasonable search and seizure" means either, not by a long shot.  Airline passenger screening is permitted under the administrative search exception,* not because it's "not unreasonable to be expected to be searched when boarding a plane."  It's going to be a very important nuance.

*Essentially, the search is done for non-criminal purposes.  The court weighs the privacy loss against the societal need, AND there must not have been a less intrusive manner for the search.

This is a joke right? I hope so. by that logic you could be stripped searched any where by the government.

I think Ben said it best:

They who can give up essential liberty to obtain a little temporary safety, deserve neither liberty nor safety.

the police arent going to stop you driving your car and strip search you.   you dont need to get on this plane.  its just convenient.  so if you want this convenience...then they need to make sure that everyone on the plane is safe...its for the benefit of everyone on the plane and on the ground.

You say they wont now, but who thought it would come to this for planes before 9/11? What if terrorist start using car bombs? What if they start to ram buses into buildings? How about if they attack a hospital? DMV? A school, maybe using kid suicide bombers. Should we be stripped search where ever we go? Before any building we enter? Its for the benefit of those in buildings and on roads.

Also how effective are these searches and is there a better way to do this? Less evasive? Or more efficient? Maybe we should learn from those who have had this problem and use their stratigies, ie how Israel does things.

they already use car and truck bombs and thats not happening.

and checkpoints where they search cars are not unheard of.  they are used more for secure places or imminent danger.

and if you think that the US is going to start racially profiling like that, youve lost it.

How many other nations subject their citizens to strip searches before entering a plane? I really dont know just wondering.

In fairness, no country does, not even us.  This is just some mid-level government attorney staking a  rhetorical claim during oral argument.  It obviously hasn't happened yet, and my guess is that it never would.

I was hoping that was the case.

Who's to say they won't?  You don't NEED to drive, so it's not unconstitutional.

Only if you promise not to moan.

Do you really think that most TSA members want to see those scans?
