Thu Dec 20, 2007 3:14pm EST

Dec 20 (Reuters) - Activision Inc (ATVI.O: Quote, Profile, Research) said a federal judge denied The Romantics' request to stop the use of a song in Activision's video game, Guitar Hero Rocks the 80s, ensuring that sales of the game will continue.

In a statement, the video game publisher said in the ruling the judge noted that the company did exactly what it was supposed to do in developing the product. (Reporting by Swagata Gupta in Bangalore)

Good.

Good. Activision did exactly what they said they would do, what are the Romantics suing over?

Anecdote:

I now someone who works at Harmonix, he told me this story.

Remember the lyric-less Jimmy Hendrix song in GH1? Well originally their cover of the song had lyrics. The Jimmy Hendrix Foundation rejected the cover, saying the singer was terrible and would damage the Hendrix brand name. So Harmonix went back and made a new cover.

The JHF now said the cover was TOO GOOD. That people would confuse the cover with the real thing. Harmonix said screw it and yanked the lyrics out all together.

There is no such thing as a console war. This is the first step to game design.
