According to Sony in the Other OS lawsuit, once your console is out of warranty the agreement between you and Sony is null and void and no agreement between you and Sony exists therefore they can remove ANY feature they want from the system by threatening removal of another feature. So they could theoretically remove your ability to play PS3 games in a firmware update if they really felt like it. According to Sony in the George Hotz lawsuit... if you own a PS3... the agreements between you two still apply after the warranty period... and that's why he's guilty. See, otherwise they couldn't sue him in California, because he lives in New Jersey... they are trying to sue him according to the "You agree any legal complaints will be filed in California." provisions you usually see. Because they don't think they can win in New Jersey.
So either they should lose the Other OS case, or lose the George Hotz case because they don't have any jurisdiction in which they could prosecute him. |
Ha, now I see, thanks, actually. It really is Sony v Sony if so, but it's not like one wrong negates the right... though Sony does lose cred here. We'll see.

Yeah, they have the advantage of both trials happening at the same time.
Had they concluded the Other OS lawsuit before they started sueing Geohot... they'd of been completely screwed.
As it is, their hypocrisy will just be used in both cases to argue why they're wrong in both cases.
Had the Other OS suit been settled... the George Hotz suit would of been dismissed... instantly.
They basically are relying now on two judges to have conflicting opinions.
Worst case scenario is they lose both... which would of been possible even if the Other OS would of happened first, since the conflict is just based on if Sony even has any right to prosecute him.
Given the choice, you'd hope they'd lose the Other OS one, since their arguement their basically boils down to "As soon as your warranty stops we can legally brick your console."
If they win both they basically gain the right to "Brick your console, and if you try and fix it, we will sue you."

Define "less rights." I have the right to choose any product that suits and fits my needs/wants. So you think it's ridiculous for consumers to expect a product should do what they pay for? I buy gaming consoles because I like gaming, I didn't buy a gaming console so I can get frustrated at cheaters who are modding software to their advantage. In real life, I can easily not invite a person over if I know he cheats at, let's say, cards. It's not as easy when I'm playing with people around the world online.

Hackers have been doing it for years so yes, they do have the right. Sony wants to change that.
