Incorrect.  Even in a material breach, the breachor is entitled to some compensation under the contract for (non-gratuitious) services rendered, albeit minus the damages caused by the breach.

Remember, contract law does not care about who the "bad guy" is, it cares about economic efficiency.  Morality only enters the equation in contract law when the violator has done something incredibly egregious.  Screwing over your employer rarely, if ever, reaches that level.

EA's lawyers are only going to give a crap about EA's interests, not West and Zampelli.  There is the danger that EA's expanded resources will let them find something in discovery that W & Z's lawyers couldn't, and which will benefit all the defendants, but the more likely outcome here is that EA loses or manages to get itself dismissed as a party.  And considering that Z & W are supposed to be quite wealthy individuals, EA's added resources might ultimately be irrelevant.

Screw activision, I have loved COD since 4, but a new game every year is finally getting old. I played 4 the least, played waw way more, played mw2 the most and played black ops a lot less than mw2 even though it is the better game. COD is getting banal. Still screw Activision forever.

Wasn't suggesting EA would defend West & Zampelli, actually that'd almost be admitting they were together in the first place.   EA's laywers would clearly only argue on behalf of EA but that adds to Activisions legal costs as well.   Zack & Wiki...er.. Zampelli and West are on their own.
