No wonder they're patenting every aspect of Kinect, they want a monopoly on Kinect!
I really think some (normal looking) gloves should be made for Kinect to cut down any lag and give ultra precision.

It's awesome that MS didn't do anything about the hackers. I bet they know that stuff like this is the best press for kinect. It really makes me want one, despite recognizing the disconnect.
MS probably has looked into this and it wasn't robust enough. This likely requires near perfect positioning to work.
Consumers usually don't remember the 90% of the time it works, they remember the 10% of the time it doesn't work. That's why games for Eyetoy and webcams are so limited, there are too many edge cases that are just unsolvable without the help of a depth camera. Also, this is running on the PC which has a lot more resources to give to analysis. I expect stuff like this will be in the next generation Kinect, but it takes a lot of time to make it work for everyone in a variety of settings.
I do think that the work they are doing now will pay off large dividends in the future. It'll be hard for competitors to catch up when kinect will have had a 5 year headstart on the R&D.

As for why it's not on 360, well that depends how they're doing it. I'm guessing they connected Kinect to a PC and wrote their own routines. Depending on processing needs it might simply be that Kinect on its own hooked up to a 360 simply doesn't have the processing power available either in general or due to the design of Kinect libraries (which might be restircted to a specific amount of processing power to make sure enough remains free for games).
I'd note a lot of the hacks (MIT or otherwise) are based on Kinect hooked up to a PC not to a 360 and based on code written on the output from the camera rather than using any libraries specifically included with the 360 (so far as I can tell anyway).
As ever I remain a lot more interested i Kinect as an interface for general manipulation than a gaming peripheral, but hopefully we'll see future titles pull the two elements closer toegher.

They could, they had a safecracking tech demo a while back. According to someone from the Kinect team who posted on a different forum the reason they didn't include it was that it wouldn't work dependably enough for all different sizes of people (kids etc) or in non-ideal conditions (eg distance). There is nothing stopping a 3rd party from implementing something with finger control but I think it would only be used in specific circumstances.
