Eh... I think you've misunderstood the patent.  Sony doing a normal touchscreen wouldn't violate this in the least, the patent is for finger gestures as a means of control for touch screens.

Actually I think I just became a little more positive on the PSP 2's prospects. Rear touch controls are an interesting idea and I can start to see some interesting possibilities coming from it.

FTR I believe the DS also launched before the PSP.

I can see a lot of girls getting into that. You'd be surprised how many girls are less skilled at the old one handed unhook when compared to the guys.

Good question... I can see the casuals, who are ultra important in the handheld market, being totally confused by that.

Seems pretty easy and natural for the controls on the back.  Have two joy stick on the front for your thumbs, and then 8 buttons on the back, one for each finger. Actually sounds really nice to me. A button under every finger means less finger travel

my psp has sat in its case for years..my ds on the other hand has been used quite a bit. PSP was a waste of money...
