Well I'm studying it, but I really can't say what this means for the relationship between Nintendo and Level 5. Level 5 has no obligations to make the franchise Nintendo exclusive though, so I think it won't mean much. I bet Nintendo still wanted it on Wii, but hey what can they do?

Oh btw all of that is in-game. The cutscenes are all 2D animated.

It's already coming in 3D... Professor Layton 5 and 6 are both 3DS games.
