 Are Sony PS3 owners getting a refund over the whole Other OS fiasco? That's what the law firm of Mieselman, Denlea, Packman, Carton & Eberz P.C. says.

 

The law firm, representing plaintiff Anthony Ventura, filed a class action law suit against Sony over the removal of the PS3's Other OS feature back in late April. We haven't heard anything from Sony yet, but a report on the firm's website says:

 

Because Sony failed to defend its intentions in court, the judge decided that Sony will have to pay every PS3 owner, who bought his PS3 before March 27, 2010, a refund of 50% of the price when purchased.

 

Sony will reportedly be giving out refunds to registered PS3 owners at E3. The firm says further details will also be posted soon.

The firm has filed a lawsuit against Sony Computer Entertainment America, Inc., for Sony's decision to force users of its Playstation 3 console to either install an update that would disable the console's "Other OS" feature or lose the ability to play games with other users in the network.  The lawsuit alleges that Sony marketed the PS3 as a console that could be used as a home personal computer with a direct connection to the internet, while also offering its other online gaming and multimedia features.  Users such as Plaintiff Anthony Ventura who refused to disable his Other OS feature lost important functions such as the ability to play PS3 games online, and the ability to download new PS3 games.  Users who disabled the Other OS feature could no longer use the console as it was marketed, as a personal home computer.

The firm hopes to force Sony to make the Other OS feature, together with the other advertised features, available to all purchasers of the PS3 and/or pay refunds to owners.

The firm is seeking to prosecute the case as a class action on behalf of everyone in the United States who bought a PS3 between November 17, 2006 and March 27, 2010.  If you bought a PS3 and would like to receive additional information, please send an e-mail message to dburke@mdpcelaw.com.



I hope they lost as I do not want any company to remove features from things that I buy. A great day for consumers. But This article just seems to be written weird, don't know if i'll trust until I hear more.



50% seems like a lot to give back. That would be a nice 200$ in my case.

Wow that would seriously screw with Sony's profit margin...would it be on every PS3 sold or on just one's from certain areas of the world.



Its a US lawsuit so should only affect ps3's in the US that once had otherOS ability



Oh damn, lol. I think that would be $300, for me? (got an old 60 gig)

Would be freakin amazing if it goes through! Though that does sound way too high, can get another PS3 with that money
