Good news for Datel and a huge potential pay-day! A judge has ruled that Datl can continue to pursue five of its sixth antitrust claims filed against Microsoft over the locking out of its third party memory card. So it's very much game on, and it looks like it could be big trouble for MS. The only claim that the judge thrown out of court was the alleged monopolization of the Xbox LIVE market.

A California court has given Datel Design & Development the green light to pursue five of the six antitrust claims it filed against Microsoft over its recent locking-out of third-party Xbox 360 accessories.

In a Friday order (PDF), federal Judge Elizabeth D. Laporte denied all but one of Microsoft's motions to throw out the case Datel brought to court in November. That one claim, which Laporte said Datel could amend, was over Microsoft's alleged monopolization of the Xbox Live market.

Datel, which sells third-party memory cards and controllers for the Xbox 360, sued Microsoft after an October 2009 firmware update made its accessories incompatible with the popular video game console. Back then, Microsoft said it was a side effect of a crackdown on Xbox Live cheaters.

Good. It was a dickhead move by MS and they deserve a little hand smackage (which when all said and done this will be a "little" smack for them)

I don't think Datel will win the suit. Interesting to see MS release encrypted USB device support shortly after the law suit was filed. Perhaps this is their way to eliminate the monopolization fears.

So, looks like we see a reason for the move to USB drives on the part of Microsoft and the 360. Microsoft will likely end up dropping the memory card slots from their newer 360 models, as part of the cost-cutting reengineering.
