The bar is even higher on patents, especially when you read patents for games.  In the end this sounds like Nintendo is going to nuke PocketPair as they will have them wrapped up in court and fees for years draining all the revenue they have obtain and put them in limbo for a sequel.  This may not be a move to win a lawsuit but to flex against a much smaller company letting them know they got to close to the sun.

I've read that in this specific case a patent lawsuit is easier for Nintendo than a copyright lawsuit hence why they went with a patent lawsuit and not a copyright one, plus we have all sorts of patent troll companies and then examples like Warner Bros patenting the Nemesis System which isn't exactly a ground-breaking concept, resulting in nobody ever using it, Lol. But yes Nintendo will win, they have an amazing track-record in legal matters, they have access to the best lawyers in Japan, they will drown Pocketpair in legal fees or win the court case outright.

Best case scenario feels like it would be Pocketpair just paying Nintendo for the license to the trademark.
