One point Hines has driven home for Microsoft is that the Bethesda games they decided not to release on PS (at least not initially) have a rather different profile from CoD.

Spencer's response: "The upside here is that a game coming from bethesda that everyone is excited about. The downside is that a large percentage of output will not benefit the playstation community in any way."

"We are going to continue to approach on a title-by-title basis, and decide on what is best for those games, what is best for us."

Judge Corley now asked Pete Hines about why they renegotiated and amended the agreement with Disney regarding Indiana Jones. Hines explained they signed the original deal as a small independent publisher, very different from being part of Microsoft.

Before acquisition, we were a small independent publisher. We are not somebody who can afford misses or failures. Being independent and fighting publishers that are multiple times larger than you, we can't afford to miss. We have to stack the deck in our favor.
