Sony really fucked up with that push to exclude Nintendo huh, Lmao.

I don't even agree with the market definition without Nintendo, I think it's stupid, but Sony brought it on themselves and CMA/FTC decided to go along with the stupid definition so here we are.

What I will say though is that Japan has NOT said they agree with the definition and hasn't actually yet made a single comment on how they define the market so I don't know about going after Japan specifically, yet.

Can't they tell FTC to knock it off instead? Lol.

Today, we write to bring to your attention the imbalanced Japanese video game market, which we are concerned may be a result of a discriminatory trade practice that could violate the spirit of the U.S.-Japan Digital Trade Agreement,”

Between the lines: Article 8 of the 2019 U.S.-Japan Digital Trade Agreement calls for the countries to enable “non-discriminatory treatment of digital products” which would include games. It’s less clear if it would also pertain to game consoles.

What I would say is the angle they're gunning for is interesting....They are targeting US-Japan trade deals, an interesting tactic.
