Try using the Apple logo and calling your product iPhone and see what happens the is a reason you need to be licensed to use a trademark, it doesn't matter what the cause is a company has to take action otherwise everyone would abuse it and cite the people using it as a defence. The one thing with Nintendo is that they're consistent on their stance whether people like it or not.
