The content owner could possibly forbid the listing of that game on digital store or not allow the free patches like on Smart Delivery. But if the console itself is BC without needing any patch (which seems the case for the PS5) then the publisher can`t really prevent that, at most they can limit you to play it without any manual patches, locking that to the PS5 version purchased.
