I think that's going to be an issue with more than just Mickey.  Disney is super protective of their characters.  I imagine it would be hard for a lot of developers to work with the restrictions Disney would likely put into licenses for many of their family-friendly IPs.  

True, but it varies.  Mickey represents Disney in a way that other characters don't.  The best example is Donald Duck.  It's not like they're going to make a Conker style Donald Duck game, but Donald Duck is frequently shown to be arrogant, grumpy, mean, greedy, and sometimes even bullying.  Mickey really can't be any of those things.  

Even back when Walt was alive, there was a reason why they were allowed to do this with Donald Duck, but would never had put Mickey in that situation.  (One of the best cartoons ever btw.)
