Marvel and Insomniac have both stated that the gaming deal came because Marvel approached Sony to make a game on any IP. Sony went to Insomniac. Insomniac chose Spiderman.

It's that simple.

The arrangement sony has with marvel is such that s long they release a spiderman movie every 5yrs 9 months they can keep the license.

Marvel envisioned what one of their IP could sell if it was done in the manner of Sony 1st party games by Sony themselves rather than the usual tie in formula so offered Sony a choice of IP and we know the rest and that success pretty much means Spiderman games are Insomniacs plaything till the day they  feel ill used and talk Sony into letting them go while signing a twenty year deal for a game called What's My Destiny Again ?, but don't despair Sony will created 686 studios with people from Insomniac ok the janitor from Insomniac.
