Not really that much of a difference. In both cases the blame gets diverted away from the culprits and towards the victims.

The biggest difference is that rape is physical and psychological harm while the response to kneeling during the anthem was restricted to psychological terror like shaming and slander.

Except to misinterpret someone is not a crime, it's just human error. A gesture like kneeling is likely to invite misinterpretation due to its ambiguity.

Rape IS a crime.
