Public or private also doesn't define the size of the school.
If he so wanted and there isn't any law forbidding in USA he could make his school on a size that could house almost all students on the neighborhood. And if he can't pay for everyone education he can certainly determine price of tuition as a fixed percentage of family income, like 5%.
