As much as this initially shocked me when I saw it a couple days ago, I think there is precidence that exists which could prevent any legal troubles beyond paying for the lawyers ... Hip-Hop and Rap music has been guilty of "Plagiarism" on thousands of songs and it is possible that the developer could argue that Sampling game content was no different than sampling music and only be forced to pay token licencing fees to the creaters of the content.
