If a developer REALLY  wanted to use the harddrive, they would.  They would just put a "Requires Xbox 360 harddrive" sticker on the box.  Majoras mask required an expansion pack, as did Donkey kong 64.  Donkey Kong 64 packed it in with the game.  They could sell a version with the harddrive packed in for a slight discount ($120-$130). Or just sell it alone, as Majoras Mask was, and require the consumer to go out and buy the harddrive themselves if they indeed didn't have one.  This is the exact same thing to me.  I really don't see the difference.
