Them still allowing MLB to sell the licence to other 3rd party companies is one thing, but I'd be quite surprised if they don't have a "can't sell the licence to Microsoft/Nintendo" part in their licence agreement.

There's an article somewhere about 2K not renewing/losing the license and Nintendo/MS electing not to make games for their systems.

I don't think you can assign the 3rd party license, as that would be extremely atypical for a licensing agreement.
