Actually, that makes me wonder if game publishers are going to object to this, since if the download speeds are throttled it'll make people less willing to download digital games.

Or they offer a premium package which they use to pay off the isp to give the data of premium users priority.
Same as you have Hulu premium without commercial breaks.
