I'm sure you're aware that the "Enix" part of Square-Enix stands for Enix.
Any publishing rights are likely to have been brought along for the merger.
And althought Quintet developed that specific game, it was quite common at the time for publishers to buy out the IP-rights entirely.
Not saying this is how it happened, just that it might be more likely for SE to own the rights for making a new Actraiser, should they want to, than for the opposite to be true.
