I'll answer again as i edited my previous post too late.
Kinder surprise is banned in some countries. A case can be made with physical goods that you still get a physical product. Digital goods are just a number beeing randomly rolled, just like in the casino.
The third example you gave is not gambling. Thats just a machine you aim at things. It depends on skill.
