In the US, it has improved but still scarce.  Though keep in mind, the US is a huge country with many different sub-economies and markets.  So in some areas, you may be able to find them easier than others.  Right now Nintendo seems to have prioritized Game Stop, Walmart, and Target over Amazon, likely due to the fact that Amazon is overrun by scalpers using bots.  Still scalpers hitting the other locations, but it's not quite as bad.  And yes, Nintendo cares about scalpers since obviously scalpers don't buy software, they just slow the growth of the consumer base that will and cause PR damage.  

I would say things have gotten overall better in general.  It's still a moderate challenge in the region of the US I am in, but not as bad as it once was.
