His point still stands though as it's not an official release, CEMU has nothing to do with any contract Nintendo has in place in regards to the game, considering no one else wanted to fund the game and PG themselves said the game was dead and not going to be developed until the deal came along I think it's not farfetched thinking an air tight exclusive deal was given as no one else wanted to take the game on not even Sega who own the IP.
