The ip is not owned by ms therefore it is third party. To be third party said game must be contractually commissioned.

Does Sony own the Call of Duty IP? Because they published it in Japan and call that second party. With Sunset were not even talking about just publishing, it was entirely funded by Microsoft. It's a second party game. Or maybe you know more about these deals than Yoshida?
