It is known for a while now:
The NVidia Shield throttles at max clock speeds (and even drastically blow max) and can not obtain those for longer than a few seconds. This is why it seems Nintendo capped clock speeds to ensure permanent use at those lower speeds.
So what we basically have now is a standard NVidia Shield TV with drastically improved APIs.
