Piracy is illegally acquiring and playing a game in which you did not pay for.  Emulation is playing a piece of software on hardware it wasn't made for.  It's really as simple as that.  You can play a legal game on a Wii U. You can play a legal game on an emulator.  You can play an illegal game on a Wii U. You can play an illegal game on an emulator.

Case in point. I bought both Xenoblade Chronicles and Skyward Sword for the Wii.  It was around this time that emulators were good enough to play these games on a PC.  So I did, with superior graphics.  My cousin definitely pirated Skyward Sword and played it on his Wii.  I emulated.  He didn't.  He pirated.  I didn't.
