It's very simple. You can eat sweets, fast food, drink alcohol and none of that will kill or affect me. But if you smoke near me, and that shit gets into my airways, it can and will have an impact on my body. You should not have that right. Smoke all you want, I don't care. But I believe I have the right to NOT have said smoke in my face or around me. 

Its not simple.That discussion lies in a grey area.You say drinking wont affect you, but what if the guy who got drunk went out driving?And the accidents he causes that kills innocent persons that had nothing to do with it?Should we ban people from drinking in bars too then?

Or how about dogs and cats?There are myriad persons who are allergic to them, some of them really allergic to them.Should we also ban people from walking with their dogs outside?Because you know, the ones walking on the street have the right to have NO fur on their faces and choke and whatnot.

If you go into this line of thought, everyone would be banned eventually, because it affects persons one way or another.We live in a society, and for a society to function, "sacrifices" needs to be made.
