There is no theory called "the theory of evolution".  There is "the theory of evolution by natural selection".  This is a model that explains the observable phenomena of evolution.  It doesn't address the question of whether or not evolution happens.  It addresses how the observable phenoma of evolution works.

You stated it was not a theory. I stated it was a theory... And then you continue to state it's not a theory. Ergo. Not the same.

If someone says "The Theory of Evolution" that does generally include everything under that heading, including natural selection... And also includes other aspects of evolution not related to natural selection.

Ergo, The Theory of Evolution is indeed a real thing.

When someone says the theory of evolution, they are erroneously referring to something that does not exist as an actual scientific theory.

If you mean that there is a theory of evolution in the sense that people use that phrase, then yeah I guess.  If you mean that there is an actual scientific theory called "the theory of evolution" then no it isn't.  There are several different theories explaining evolution the most prominent is the theory of evolution by natural selection. 

The theory of evolution is a misnomer.  It's a misnomer that suggests evolution itself is in question, so it should be avoided.
