Liable also means "likely to be affected or harmed by something". Your thinking of "legally responsible for something". But breaking an NDA is in fact the latter. Helping someone to break an NDA does have legal ramifications. Basically Digital Foundry is receiving the information illegally.

That is absolutely not how libel laws work.

Also, what the hell? Digital Foundry is always very clear about what they're reporting and how they come up with there assumptions. What is your problem with them?
