The news is based on facts. Digital Foundry clearly states what part of there articles/videos is the information they've recieved, and what part of there content is what they believe to be the case.

Liable also means "likely to be affected or harmed by something". Your thinking of "legally responsible for something". But breaking an NDA is in fact the latter. Helping someone to break an NDA does have legal ramifications. Basically Digital Foundry is receiving the information illegally.
