I would assume they can see or know if someone had technical issues that made it unplayable and or how long they actually played.
If that's possible I don't see why not.
I'd be disqualified and that's ok because I don't think it's fair for me to ask for a refund if I only had two crashes (way less than a lot of games praised on the Internet) and I played the thing for many hours (not sure how much but well beyond $60 worth of entertainment value for sure).
Other than that I've bought many games in my life and many have not been what I expected based off advertising and I've never gotten a refund that I can remember except on a very few major mess ups. In fact the only one I can think of is EA selling me APB and then shutting down the servers like a month after launch like the royal asses they are. Even then I was refused a refund and given a game instead.
Taking it even further I've bought so many games since the Vic 20 I'm amazed this game of all the absolute dung I've shoveled through over the years is the one people have planted their flags on. I simply don't get it.
