Huh?  Anything you downloaded on Wii can be played on Wii U, and anything digital on the DSi can be played on the 3DS.  There's no reason why downloadable games should be less b/c capable than physical games, unless the developer wants to fuck you over.

Nintendo's the only exception - well other than the fact that you have to go through an annoying process to transfer the titles - but my post was mainly towards Sony and MS. (Though we'll know in a few months if Nintendo will continue being the way they were this gen).

Other than that even if the systems could handle b/c - they wont because they know they can easily make money off of people who are willing to re-purchase the game just to play it on the latest platform (majority will).

Actually... I think thee PS4 is the only system that doesn't have digital BC in some capacity.

XBox 360 has digital BS on the same titles it has retail BC.  Vita ONLY has backwards compatibility with digital games.  The only current gen system with no BC is PS3-PS4, and that doesn't have BC for either physical or retail.  Even then I don't think it's an effort to actively attack consumers.  The architecture is just completely different.
