They didn't have a choice Mark Cerny then head of Universal interactive offered ND who rented office space at the Universal lot , money to make them a game since they had just formed Universal interactive and needed product , Cerny's offer was we will fund a game from you sight unseen but we in return will own the IP , that game eventualy became crash, Cerny made the same offer to Insomniac who where also renting at the lot and that's how they got Spyro.

Sony came into the picture when they after seeing Crash at an event decide to publish it.
