Harmonix is the publisher. Mad Catz is the distributor and doesn't have any rights to the franchise. 

A quick google suggests they "co-published"

 

Though I did find a story that completely slipped me by in the process. Harmonix have another co publisher and sounds like there will be another update/new instruments in autumns.
