Alan Wake was heavily inspired by Twin Peaks, but it was far, far different to be called "almost an exact copy". Deadly Premonition has more akin to Twin Peaks - particulary with the main character - and that game is still very different from the source of inspiration.
Just because something is inspired or based on another source doesn't mean they have to be copies of each other. The prime example is I, Robot, which was inspired by the works of Isaac Asimov but has not much in relation to the short stories Asimov wrote. It still have fundamentals taken out and plastered in the movie, just like Alan Wake has fundamentals of Twin Peaks appearing in-game, or to quote other games, The Last of Us has fundamentals of The Road and No Country for Old Men incorporated, or Dead Rising has that Romero-esque supermarket flavor on it. And why should them be deducted by borrowing elements? Unless it is a rip-off, and you could argue that being derivative is something bad, I don't see the problem.
