You are right in all legal ways off course. The BBC can protect it's brands this way.
I think that the BBC is merely trying to stay ahead of the curve. They see that the figurines are already being sold on eBay, it could very well lead to large-scale production in China. I know that this is an argument of the type "Slippery slope" but there have been so many examples of products leading up to these shennanigans (someone mentioned fake purses?) so I can't really blame them for nipping it in the butt before it spirals out of control.
Though I do hope that the BBC only asks for a cease and decist, and does not plan on some kind of financial gain.
