What you're talking about has nothing to do with this situation. There is literally nothing the developers can do except build the game all over again for the Wii U in a different engine or wait and hope that Nintendo and the company who developed the game engine reach a deal. As for the first option, it is unrealistic to expect them to stop development on the other versions just to work on a version that would ONLY exist for the sake of the Wii U. It's even possible that they can't afford to do that before they make some money on the other platforms--by which time, the Wii U might no longer be a viable platform.
From everything I've read, the developers made their Kickstarter proposal in good faith. A LOT of engines don't support certain platforms from the beginning, requiring game developers to trust what they're being told.
As I said before, this is about GameMaker: Studio and Nintendo. Nintendo has to give permission for YoYo Games, the developers of GameMaker: Studio, to build an export module that works with the Wii U but they have been unable to reach an agreement. Why, I don't know. Could be the fault of either one or both. If anything, the developers of HLD are the ones being screwed over the most.
