Reading back over it, I don't really understand the problem. The "she should have let him rape her then" comments seem especially silly. The fine isn't for defending herself, it's for being in possession of an illegal item. Those two things are not the same.
As for why pepper spray might be illegal, I would assume that it has to do with how dangerous it can be, including possible fatal consequences.
